【沿革】

.联合国大会一九八九年十一月二十日第四十四/二十五号决议通过并开放给各国签字、批准和加入生效;按照第四十九条规定,于一九九○年九月二日生效(民国78年11月20日修正) .Adopted and opened for signature, ratification and accession by General Assembly resolution 44/25 of 20 November 1989 entry into force 2 September 1990, in accordance with article 49

【前言】

  本公约之签约国遵照联合国宪章所揭示之原则,认为承认所有人类社会成员所拥有的固有尊严与平等之不可剥夺的权利,才能巩固世界的自由、正义与和平之基础。
  考虑联合国各国国民再度确信在联合国宪章之下,确保基本人权和人类尊严与价值之信心,以及在更大的自由中,促进社会进步与提高生活水准的决心。
  同意承认联合国在世界人权宣言国际人权规约中所揭示,无论任何人不分种族、肤色、性别、语言、宗教、政治或其他信念,国民或社会背景,财产、出生或其他地位之差别,均享有上述宣言与规约所揭示之所有权利与自由。
  强调联合国在世界人权宣言中,宣称儿童有权接受特别养护与协助的宣言。
  确信家庭为社会之基本团体,是所有成员特别是儿童成长与福祉之自然环境,故应获得必要之保护与协助,才能使其在社区中充分担当其责任。
  承认儿童应在家庭环境中,在幸福、爱情以及了解之气氛中成长,才能使其人格得到充分和谐之发展。
  考虑儿童应受到充分之训练,使其能在社会中过其个人独立生活。并应在联合国宪章所揭示之理想精神,特别是在和平、尊严、宽容、自由、平等以及团队精神之下获得培育成长。
  要留意扩充儿童特别养护工作之必要性。因为这是一九二四年有关儿童权利之日内瓦宣言,以及一九五九年联合国所制订之儿童权利宣言所强调,也是世界人权宣言,有关市民和政治权利之国际规约(特别是第二十三条以及第二十四条),有关经济、社会与文化权利之国际规则(特别是第十条),以及有关儿童福祉之专门机构和国际机构之各种规程和相关文书所认同。
  要留意联合国会员大会在一九五九年十一月二十日所制订有关儿童权利宣言所揭示“儿童之身体和精神都在未成熟状态,因此在其出生前后应获得包括适当之法律等特别保护与养护条文。并应留意有关儿童保护与福祉之社会与法律原则之宣言条款(特别是关于养父母以及国内与国际收养制度),与联合国有关少年受审司法最低标准规则(北京规则),以及有关紧急状态与武力纷争中保护女子与儿童宣言之各条款。
  在充分考虑保护儿童使其身心获得均衡发展,并强调各国国民传统与文化价值之重要前提下,一致认为要改善所有国家,尤其是开发中国家儿童之生活状况,必须认识国际合作之重要性,因此同意订定下列协定条款:
  The States Parties to the present Convention,
  Considering that, in accordance with the principles proclaimed in the Charter of the United Nations, recognition of the inherent dignity and of the equal and inalienable rights of all members of the human family is the foundation of freedom, justice and peace in the world,
  Bearing in mind that the peoples of the United Nations have, in the Charter, reaffirmed their faith in fundamental human rights and in the dignity and worth of the human person, and have determined to promote social progress and better standards of life in larger freedom,
  Recognizing that the United Nations has, in the Universal Declaration of Human Rights and in the International Covenants on Human Rights, proclaimed and agreed that everyone is entitled to all the rights and freedoms set forth therein, without distinction of any kind, such as race, colour, sex, language, religion, political or other opinion, national or social origin, property, birth or other status,
  Recalling that, in the Universal Declaration of Human Rights, the United Nations has proclaimed that childhood is entitled to special care and assistance,
  Convinced that the family, as the fundamental group of society and the natural environment for the growth and well-being of all its members and particularly children, should be afforded the necessary protection and assistance so that it can fully assume its responsibilities within the community,
  Recognizing that the child, for the full and harmonious development of his or her personality, should grow up in a family environment, in an atmosphere of happiness, love and understanding,
  Considering that the child should be fully prepared to live an individual life in society, and brought up in the spirit of the ideals proclaimed in the Charter of the United Nations, and in particular in the spirit of peace, dignity, tolerance, freedom, equality and solidarity,
  Bearing in mind that the need to extend particular care to the child has been stated in the Geneva Declaration of the Rights of the Child of 1924 and in the Declaration of the Rights of the Child adopted by the General Assembly on 20 November 1959 and recognized in the Universal Declaration of Human Rights, in the International Covenant on Civil and Political Rights (in particular in articles 23 and 24), in the International Covenant on Economic, Social and Cultural Rights (in particular in article 10)and in the statutes and relevant instruments of specialized agencies and international organizations concerned with the welfare of children,
  Bearing in mind that, as indicated in the Declaration of the Rights of the Child, "the child, by reason of his physical and mental immaturity, needs special safeguards and care, including appropriate legal protection, before as well as after birth",
  Recalling the provisions of the Declaration on Social and Legal Principles relating to the Protection and Welfare of Children, with Special Reference to Foster Placement and Adoption Nationally and Internationally; the United Nations Standard Minimum Rules for the Administration of Juvenile Justice (The Beijing Rules); and the Declaration on the Protection of Women and Children in Emergency and Armed Conflict, Recognizing that, in all countries in the world, there are children living in exceptionally difficult conditions, and that such children need special consideration,
  Taking due account of the importance of the traditions and cultural values of each people for the protection and harmonious development of the child, Recognizing the importance of international co-operation for improving the living conditions of children in every country, in particular in the developing countries,
  Have agreed as follows:

第一章

第1条(儿童之定义)


  本公约所称之“儿童”,系指所有未满十八岁以下之人。然而适用于儿童之法律中,规定在十八岁以前就成为成年者不在此限。

Article 1


  For the purposes of the present Convention, a child means every human being below the age of eighteen years unless under the law applicable to the child, majority is attained earlier.

第2条(禁止差别待遇)


  一、签约国不得因儿童本人或其父母或法定监护人之种族、肤色、性别、语言、宗教、政治或其他主张、国籍、出身、财富、残障、出生或其他地位之不同而有所歧视。应尊重并确保其辖区内每一儿童在本公约中所揭橥之权利。
  二、签约国应采取一切适当措施,确保儿童免于因父母、法定监护人或家族成员之地位、行为、主张或信念之关系而遭受各种差别待遇或处罚。

Article 2


  1.States Parties shall respect and ensure the rights set forth in the present Convention to each child within their jurisdiction without discrimination of any kind, irrespective of the child's or his or her parent's or legal guardian's race, colour, sex, language, religion, political or other opinion, national, ethnic or social origin, property, disability, birth or other status.
  2.States Parties shall take all appropriate measures to ensure that the child is protected against all forms of discrimination or punishment on the basis of the status, activities, expressed opinions, or beliefs of the child's parents, legal guardians, or family members.

第3条(儿童的最佳利益)


  一、所有关系儿童之事务,无论是否由公私社会福利机构、法院、行政当局或立法机关所主持,均应以儿童之最佳利益为优先考虑。
  二、签约国应考虑儿童之父母、法定监护人或其他依法对儿童负有责任之个人所应有之权利与义务,确保儿童之福祉与必要之保护与照顾,并以适当之立法和行政措施达成此目的。
  三、签约国应对负责照顾与保护儿童之机构、服务部门与设施,特别在安全与保健方面,以及该等机关内之工作人数与资格是否合适,且是否合乎有权监督机构所订之标准,作严格之要求。

Article 3


  1.In all actions concerning children, whether undertaken by public or private social welfare institutions, courts of law, administrative authorities or legislative bodies, the best interests of the child shall be a primary consideration.
  2.States Parties undertake to ensure the child such protection and care as is necessary for his or her well-being, taking into account the rights and duties of his or her parents, legal guardians, or other individuals legally responsible for him or her, and, to this end, shall take all appropriate legislative and administrative measures.
  3.States Parties shall ensure that the institutions, services and facilities responsible for the care or protection of children shall conform with the standards established by competent authorities, particularly in the areas of safety, health, in the number and suitability of their staff, as well as competent supervision.

第4条(权利的实施)


  签约国应采取所有适当的立法、行政及其他措施,实现本公约所认定的各项权利。关于经济、社会以及文化的权利方面,签约国应利用其本国最大可用之资源,于必要时可以在国际合作组织体制下,采取各项措施。

Article 4


  States Parties shall undertake all appropriate legislative, administrative, and other measures for the implementation of the rights recognized in the present Convention.With regard to economic, social and cultural rights, States Parties shall undertake such measures to the maximum extent of their available resources and, where needed, within the framework of international co-operation.

第5条(父母及其他人员的指导)


  签约国应尊重儿童之父母,或依其情节,因地方习俗所衍生的家属或共同生活成员、其法定监护人或其他依法对其负责之人,以适合儿童身心发展的方式,对正确指导儿童行使本公约所承认的权利时所应有的责任、权利与义务。

Article 5


  States Parties shall respect the responsibilities, rights and duties of parents or, where applicable, the members of the extended family or community as provided for by local custom, legal guardians or other persons legally responsible for the child, to provide, in a manner consistent with the evolving capacities of the child, appropriate direction and guidance in the exercise by the child of the rights recognized in the present Convention.

第6条(生存和发展)


  一、签约国承认儿童与生俱有之生存权利。
  二、签约国应尽最大可能确保儿童的生存与发展。

Article 6


  1.States Parties recognize that every child has the inherent right to life.
  2.States Parties shall ensure to the maximum extent possible the survival and development of the child.

第7条(姓名与国籍)


  一、儿童于出生后应立即被登记,儿童出生时就应有取得姓名以及国籍的权利。在可能的范围内有知其父母并受父母照顾等权利。
  二、当儿童无法取得其他国家国籍时,签约国应根据其国家法令及其在相关的国际文件上所负的义务,让儿童的前项权利确实实现。

Article 7


  1.The child shall be registered immediately after birth and shall have the right from birth to a name, the right to acquire a nationality and.as far as possible, the right to know and be cared for by his or her parents.
  2.States Parties shall ensure the implementation of these rights in accordance with their national law and their obligations under the relevant international instruments in this field, in particular where the child would otherwise be stateless.

第8条(身分的保障)


  一、签约国应尊重儿童的权利,以保障其国籍、姓名与亲属关系等等依法所享有的个人身分不受非法侵害。
  二、签约国于儿童之任何个人权利受不法侵害时,应给予适当之协助与保护,俾迅速恢复其身分。

Article 8


  1.States Parties undertake to respect the right of the child to preserve his or her identity, including nationality, name and family relations as recognized by law without unlawful interference.
  2.Where a child is illegally deprived of some or all of the elements of his or her identity, States Parties shall provide appropriate assistance and protection, with a view to re-establishing speedily his or her identity.

第9条(禁止与双亲分离)


  一、签约国得违反父母之意思,保护儿童不与其父母分离;但当局若经法院审查后循合法程序裁定儿童与其父母分离对该儿童为有利者,不在此限。儿童受父母虐待、遗弃或在父母离异时,该项裁决尤有其必要,此时,该儿童之住所应一并裁定。
  二、根据前项为法律诉讼时,各关系人均得出席并申诉意见。
  三、签约国应尊重与父母任何一方或双方分离时的儿童权利,使其能定期与父母直接接触并保持私人关系;但因此违背该儿童之最佳利益者,不在此限。
  四、当分离系肇因于父母一方或双方或儿童受扣押、监禁、放逐、驱逐出境或死亡(包括任何原因造成签约国看管下之人的死亡)时,该签约国受有请求时,应在不损害该儿童福祉的情况下,给予该父母、儿童或视其情节,给予其他家属有关失踪家属下落的消息。惟签约国应确保任何关系人不因该请求而蒙受不利。

Article 9


  1.States Parties shall ensure that a child shall not be separated from his or her parents against their will, except when competent authorities subject to judicial review determine, in accordance with applicable law and procedures, that such separation is necessary for the best interests of the child.Such determination may be necessary in a particular case such as one involving abuse or neglect of the child by the parents, or one where the parents are living separately and a decision must be made as to the child's place of residence.
  2.In any proceedings pursuant to paragraph 1 of the present article, all interested parties shall be given an opportunity to participate in the proceedings and make their views known.
  3.States Parties shall respect the right of the child who is separated from one or both parents to maintain personal relations and direct contact with both parents on a regular basis, except if it is contrary to the child's best interests.
  4.Where such separation results from any action initiated by a State Party, such as the detention, imprisonment, exile, deportation or death (including death arising from any cause while the person is in the custody of the State)of one or both parents or of the child, that State Party shall, upon request, provide the parents, the child or, if appropriate, another member of the family with the essential information concerning the whereabouts of the absent member(s)of the family unless the provision of the information would be detrimental to the well-being of the child.States Parties shall further ensure that the submission of such a request shall of itself entail no adverse consequences for the person(s)concerned.

第10条(家族的团聚)


  一、儿童或其父母为团聚而请求进入或离开签约国时,签约国应遵照第九条第一项规定之义务以积极、人道与通融的方式处理之。签约国并应确保请求人或其家属不因该请求而蒙受不 利。
  二、父母分住于不同国家之儿童,除情况特殊者外,有权与其父母定期直接接触保持私人关系。签约国应遵照第九条第二项规定之义务,尊重儿童及其父母得离开任何国家,包括进出自己国家的权利。而出国之权利除依法且不违背公约所承认之其他权利,并为保障国家安全、公共秩序、公共卫生与道德以及他人之权利与自由者外,不得加以限制。

Article 10


  1.In accordance with the obligation of States Parties under article 9, paragraph 1, applications by a child or his or her parents to enter or leave a State Party for the purpose of family reunification shall be dealt with by States Parties in a positive, humane and expeditious manner.States Parties shall further ensure that the submission of such a request shall entail no adverse consequences for the applicants and for the members of their family.
  2.A child whose parents reside in different States shall have the right to maintain on a regular basis, save in exceptional circumstances personal relations and direct contacts with both parents.Towards that end and in accordance with the obligation of States Parties under article 9, paragraph 1, States Parties shall respect the right of the child and his or her parents to leave any country, including their own, and to enter their own country.The right to leave any country shall be subject only to such restrictions as are prescribed by law and which are necessary to protect the national security, public order (ordre public), public health or morals or the rights and freedoms of others and are consistent with the other rights recognized in the present Convention.

第11条(非法移送国外及非法不送还)


  一、签约国应采取遏止非法移送儿童至国外或令其无法回国等情事之发生。
  二、签约国应致力缔结双边或多边条约或参加现有的协约以达成前项遏止之目的。

Article 11


  1.States Parties shall take measures to combat the illicit transfer and non-return of children abroad.
  2.To this end, States Parties shall promote the conclusion of bilateral or multilateral agreements or accession to existing agreements.

第12条(儿童的意见)


  一、签约国应使有意思能力之儿童就与其自身有关事务有自由表意之权利,其所表示之意思应依其年龄大小与成熟程度予以权衡。
  二、据此,应特别给予儿童在对自己有影响之司法和行政诉讼中,能够依照国家法律之程序规则,由其本人直接或透过代表或适当之团体,表达意见之机会。

Article 12


  1.States Parties shall assure to the child who is capable of forming his or her own views the right to express those views freely in all matters affecting the child, the views of the child being given due weight in accordance with the age and maturity of the child.
  2.For this purpose, the child shall in particular be provided the opportunity to be heard in any judicial and administrative proceedings affecting the child, either directly, or through a representative or an appropriate body, in a manner consistent with the procedural rules of national law.

第13条(表现的自由)


  一、儿童应有自由表意之权利,该权利应包括以言辞、书写或印刷、艺术形态或透过儿童自己决定的媒介,不受国境限制地寻取、接受、传达任何资讯与意思。
  二、该项权利之行使仍应受法律规定与需要之限制。其限制仅在于达到下列目的所需要者为限。
  1.为尊重他人之权利与名誉。
  2.为保障国家安全或公共秩序或公共卫生与道德。

Article 13


  1.The child shall have the right to freedom of expression; this right shall include freedom to seek, receive and impart information and ideas of all kinds, regardless of frontiers, either orally, in writing or in print, in the form of art, or through any other media of the child's choice.
  2.The exercise of this right may be subject to certain restrictions, but these shall only be such as are provided by law and are necessary:
  (a)For respect of the rights or reputations of others; or
  (b)For the protection of national security or of public order (ordre public), or of public health or morals.

第14条(思想、良知及信仰的自由)


  一、签约国应尊重儿童思想、良知与宗教的自由权利。
  二、签约国应尊重父母与依其情节之法定代理人以不影响儿童身心发展的方式,指导儿童行使权利时所应负的权利与义务。
  三、个人宣示其宗教与信仰的自由,仅受法律所规定者与保障公共安全、秩序、卫生或道德,或他人基本权利与自由所必需之限制。

Article 14


  1.States Parties shall respect the right of the child to freedom of thought, conscience and religion.
  2.States Parties shall respect the rights and duties of the parents and, when applicable, legal guardians, to provide direction to the child in the exercise of his or her right in a manner consistent with the evolving capacities of the child.
  3.Freedom to manifest one's religion or beliefs may be subject only to such limitations as are prescribed by law and are necessary to protect public safety, order, health or morals, or the fundamental rights and freedoms of others.

第15条(集会、结社的自由)


  一、签约国承认儿童有结社与和平集会之自由。
  二、除依法在民主社会中为国家安全或为保障公共安全、社会秩序、公共卫生或道德或他人之权益与自由者外,不得对该等权益之行使予以限制。

Article 15


  1.States Parties recognize the rights of the child to freedom of association and to freedom of peaceful assembly.
  2.No restrictions may be placed on the exercise of these rights other than those imposed in conformity with the law and which are necessary in a democratic society in the interests of national security or public safety, public order (ordre public), the protection of public health or morals or the protection of the rights and freedoms of others.

第16条(保护隐私权)


  一、儿童之隐私、家庭、住家或信函不可恣意或非法干预,其信用与名誉亦不可受到非法侵害。
  二、儿童对此等干预或侵害有依法受保障的权利。

Article 16


  1.No child shall be subjected to arbitrary or unlawful interference with his or her privacy, family, or correspondence, nor to unlawful attacks on his or her honour and reputation.
  2.The child has the right to the protection of the law against such interference or attacks.

第17条(适当资讯的利用)


  签约国承认大众传播有其重要功能,故应保证儿童可自国家或国际各方面获得资讯,尤其是为提升社会、精神与道德福祉与身心健康方面的资讯。为此签约国应:
  一、要鼓励有益儿童发展之社会与文化,与实现第二十九条主旨之资讯与资料等大众传播媒体能够普及。
  二、鼓励来自文化、国家、国际各方面有关此等资讯的编制、交换与传播的国际合作。
  三、鼓励儿童书籍之出版与普及。
  四、鼓励大众传播对少数民族或原住民儿童语言上的需要予以特别关注。
  五、注意第十三条及第十八条之规定,鼓励发展保护儿童使其不受有害儿童福祉之资讯伤害的适当指导方针。

Article 17


  States Parties recognize the important function performed by the mass media and shall ensure that the child has access to information and material from a diversity of national and international sources, especially those aimed at the promotion of his or her social, spiritual and moral well-being and physical and mental health.
  To this end, States Parties shall:
  (a)Encourage the mass media to disseminate information and material of social and cultural benefit to the child and in accordance with the spirit of article 29;
  (b)Encourage international co-operation in the production, exchange and dissemination of such information and material from a diversity of cultural, national and international sources;
  (c)Encourage the production and dissemination of children's books;
  (d)Encourage the mass media to have particular regard to the linguistic needs of the child who belongs to a minority group or who is indigenous;
  (e)Encourage the development of appropriate guidelines for the protection of the child from information and material injurious to his or her well-being, bearing in mind the provisions of articles 13 and 18.

第18条(父母的责任)


  一、签约国应努力使养育儿童是父母共同责任的原则获得大家认同。父母或依其情节之法定监护人应负养育儿童之主要责任。此时,儿童的最佳利益尤其应该成为他们最关心之事。
  二、为保证与提升本公约所揭示之权利,签约国应给予父母与法定监护人在担负养育儿童责任时予以适当之协助,并保证照顾儿童之机构、设备与部门业务之发展。
  三、签约国应提供一切适当措施保证父母均在工作之儿童,有权享有托育服务与托育设备之权利。

Article 18


  1.States Parties shall use their best efforts to ensure recognition of the principle that both parents have common responsibilities for the upbringing and development of the child.Parents or, as the case may be, legal guardians, have the primary responsibility for the upbringing and development of the child.The best interests of the child will be their basic concern.
  2.For the purpose of guaranteeing and promoting the rights set forth in the present Convention, States Parties shall render appropriate assistance to parents and legal guardians in the performance of their child-rearing responsibilities and shall ensure the development of institutions, facilities and services for the care of children.
  3.States Parties shall take all appropriate measures to ensure that children of working parents have the right to benefit from child-care services and facilities for which they are eligible.

第19条(防止遭受虐待及遗弃的保护措施)


  一、签约国应采取一切立法、行政.社会与教育措施防止儿童在其父母、法定监护人或其他照顾儿童之人照顾时遭受身心胁迫、伤害或虐待、遗弃或疏忽之对待以及包括性强暴的不当待遇或剥削。
  二、该等保护措施,依其情节应包括提供儿童与照顾儿童之人所需要的各种社会计划,其他形态的有效防患措施,与上述对待儿童与不当的事件的发现、报告、参酌、调查、处理与追踪措施。依其情节应包括有关司法诉讼的有效协助。

Article 19


  1.States Parties shall take all appropriate legislative, administrative, social and educational measures to protect the child from all forms of physical or mental violence, injury or abuse, neglect or negligent treatment, maltreatment or exploitation, including sexual abuse, while in the care of parent(s), legal guardian(s)or any other person who has the care of the child.
  2.Such protective measures should, as appropriate, include effective procedures for the establishment of social programmes to provide necessary support for the child and for those who have the care of the child, as well as for other forms of prevention and for identification, reporting, referral, investigation, treatment and follow-up of instances of child maltreatment described heretofore, and, as appropriate, for judicial involvement.

第20条(保护丧失家庭环境的儿童)


  一、儿童暂时或永久丧失家庭环境.或因顾及其本身最大利益无法使其留于家庭环境时,签约国应给予特别之保护与协助。
  二、签约国应依其国家法律确实给予该等儿童相同的替代照顾。
  三、该照顾应包括安排认养、依回教教义收养或必要时安置其于适当机构以尽监护儿童之责任。当选择处理方式时,应考虑养育儿童的工作能够持续不断,以及儿童之种族、宗教、文化和语言背景等,予以妥切处理。

Article 20


  1.A child temporarily or permanently deprived of his or her family environment, or in whose own best interests cannot be allowed to remain in that environment, shall be entitled to special protection and assistance provided by the State.
  2.States Parties shall in accordance with their national laws ensure alternative care for such a child.
  3.Such care could include, inter alia, foster placement, kafalah of Islamic law, adoption or if necessary placement in suitable institutions for the care of children.When considering solutions, due regard shall be paid to the desirability of continuity in a child's upbringing and to the child's ethnic, religious, cultural and linguistic background.

第21条(收养制度)


  承认或允许收养制度的签约国应保证对儿童的最佳利益给予最大关切,这些国家应:
  一、保证儿童之收养仅得由合法之机关许可。该机关应依据可适用之法律和程序以及所有可靠的有关资讯,并考虑与父母、亲戚与法定监护人有密切关系之儿童状况,设定养子关系。必要时,关系人得依据必要的辅导过程,经过充分了解后,同意该收养关系。
  二、在无法为儿童安排收养家庭,或无法在祖国给予适当照顾时,承认国家间的收养为照顾儿童的另一种方式。
  三、保证国家间所收养的儿童,享有与在国内被收养的儿童相同水准的保障与待遇。
  四、采取一切措施保证在国家间的收养安排,不会造成任何关系人取得不当财务利益。
  五、依其情况,可藉由双边或多边协议或契约的缔结促使本条款的目标得以实现,并在此种体制下,使寄养在其他国家的儿童得以由合法的机关安排收养。

Article 21


  States Parties that recognize and/or permit the system of adoption shall ensure that the best interests of the child shall be the paramount consideration and they shall:
  (a)Ensure that the adoption of a child is authorized only by competent authorities who determine, in accordance with applicable law and procedures and on the basis of all pertinent and reliable information, that the adoption is permissible in view of the child's status concerning parents, relatives and legal guardians and that, if required, the persons concerned have given their informed consent to the adoption on the basis of such counselling as may be necessary;
  (b)Recognize that inter-country adoption may be considered as an alternative means of child's care, if the child cannot be placed in a foster or an adoptive family or cannot in any suitable manner be cared for in the child's country of origin;
  (c)Ensure that the child concerned by inter-country adoption enjoys safeguards and standards equivalent to those existing in the case of national adoption;
  (d)Take all appropriate measures to ensure that, in inter-country adoption, the placement does not result in improper financial gain for those involved in it;
  (e)Promote, where appropriate, the objectives of the present article by concluding bilateral or multilateral arrangements or agreements, and endeavour, within this framework, to ensure that the placement of the child in another country is carried out by competent authorities or organs.

第22条(难民儿童)


  一、签约国应采取一切措施保证寻求难民身分,或依可得适用之国际或国内法律或程序被认为难民的儿童,不论是否与其父母或其他人随行,在享有本公约及该签约国所参加的其他国际人权公约或人道文契中所揭示的相当权利时,获得适当的保护与人道协助。
  二、为此,签约国应在其认为适当的情形下,配合联合国及其他合法政府间或与联合国有合作关系的机构共同努力保护并协助儿童。此外,并应为难民儿童寻找其父母或其他家人使其得以团圆。如无法找寻其父母或其他家属时,则应给予该儿童与本公约所揭示之永久或暂时丧失家庭环境儿童相同之保护。

Article 22


  1.States Parties shall take appropriate measures to ensure that a child who is seeking refugee status or who is considered a refugee in accordance with applicable international or domestic law and procedures shall, whether unaccompanied or accompanied by his or her parents or by any other person, receive appropriate protection and humanitarian assistance in the enjoyment of applicable rights set forth in the present Convention and in other international human rights or humanitarian instruments to which the said States are Parties.
  2.For this purpose, States Parties shall provide, as they consider appropriate, co-operation in any efforts by the United Nations and other competent intergovernmental organizations or non-governmental organizations co-operating with the United Nations to protect and assist such a child and to trace the parents or other members of the family of any refugee child in order to obtain information necessary for reunification with his or her family.In cases where no parents or other members of the family can be found, the child shall be accorded the same protection as any other child permanently or temporarily deprived of his or her family environment for any reason , as set forth in the present Convention.

第23条(残障儿童的福利)


  一、签约国承认身心残障儿童,应在确保其尊严,促进自立与积极参加社区生活之环境下,享受充分适宜之生活。
  二、签约国承认残障儿童有受特别照顾之权利,并应奖励在可能利用之资源范围内,针对有资格接受资助之儿童,以及负有养育儿童责任者所申请之援助,给予适合其状况之协助。
  三、要承认残障儿童之特别照顾,并依据第二项中规定之协助项目,在考虑父母或其他照顾儿童人士之财力情况下,尽可能给予完全免费之服务。其协助应以保障残障者能够全面参加社会活动,并有效利用教育、训练、保健服务、复健服务、职业训练以及休闲机会,以达成个人在文化与精神上之发展为原则。
  四、签约国必须遵照国际合作之精神,针对残障儿童之预防保健,以及医学上、心理学上和功能之治疗等领域有关资讯。作适当之交换。其中应包括签约国为提升残障儿童之能力与技术,扩大其经验所需要之复健教育以及就业服务有关资讯之普及。对开发中国家之需要,尤其应特别加以考虑。

Article 23


  1.States Parties recognize that a mentally or physically disabled child should enjoy a full and decent life, in conditions which ensure dignity, promote self-reliance and facilitate the child's active participation in the community.
  2.States Parties recognize the right of the disabled child to special care and shall encourage and ensure the extension, subject to available resources, to the eligible child and those responsible for his or her care, of assistance for which application is made and which is appropriate to the child's condition and to the circumstances of the parents or others caring for the child.
  3.Recognizing the special needs of a disabled child, assistance extended in accordance with paragraph 2 of the present article shall be provided free of charge, whenever possible, taking into account the financial resources of the parents or others caring for the child, and shall be designed to ensure that the disabled child has effective access to and receives education, training, health care services, rehabilitation services, preparation for employment and recreation opportunities in a manner conducive to the child's achieving the fullest possible social integration and individual development, including his or her cultural and spiritual development
  4.States Parties shall promote, in the spirit of international cooperation, the exchange of appropriate information in the field of preventive health care and of medical, psychological and functional treatment of disabled children, including dissemination of and access to information concerning methods of rehabilitation, education and vocational services, with the aim of enabling States Parties to improve their capabilities and skills and to widen their experience in these areas.In this regard, particular account shall be taken of the needs of developing countries.

第24条(医疗和保健服务)


  一、签约国承认儿童享有最高水准之健康医疗服务,并获得治疗疾病以及恢复健康之权利。签约国要保证所有儿童利用保健服务之权利不会遭到剥夺。
  二、签约国为促使这些权利完全实现,应特别针对左列事项采取适当之措施:
  1.降低婴儿与儿童之死亡率。
  2.把重点放在基本卫生照顾上,并保证提供所有儿童所必需之医疗协助和保健服务。
  3.随时注意环境污染之危险性,并在基本卫生照顾之体系下,特别利用可能之技术,提供儿童具有充分营养价值之食物,和干净之饮用水,藉以防止疾病与营养不良之情事发生。
  4.保证母亲获得产前产后之适当保健服务。
  5.提供所有社会成员,尤其是父母和儿童,有关儿童健康和营养:母乳营养之好处保健卫生和环境卫生;以及防止意外事故之基本知识。除施行有关之教育外,并协助利用有关之资讯。
  6.发展预防保健以及对父母之指导和家庭计划之教育等服务。
  三、签约国应采取一切有效之适当措施,革除对儿童健康有害之传统习惯。
  四、签约国为使本条文所认定之权利能够逐渐达成,要鼓励并促进国际合作。
  尤其应特别考虑开发中国家之需要。

Article 24


  1.States Parties recognize the right of the child to the enjoyment of the highest attainable standard of health and to facilities for the treatment of illness and rehabilitation of health.States Parties shall strive to ensure that no child is deprived of his or her right of access to such health care services.
  2.States Parties shall pursue full implementation of this right and, in particular, shall take appropriate measures:
  (a)To diminish infant and child mortality;
  (b)To ensure the provision of necessary medical assistance and health care to all children with emphasis on the development of primary health care;
  (c)To combat disease and malnutrition, including within the framework of primary health care, through, inter alia, the application of readily available technology and through the provision of adequate nutritious foods and clean drinking-water, taking into consideration the dangers and risks of environmental pollution;
  (d)To ensure appropriate pre-natal and post-natal health care for mothers;
  (e)To ensure that all segments of society, in particular parents and children, are informed, have access to education and are supported in the use of basic knowledge of child health and nutrition, the advantages of breastfeeding, hygiene and environmental sanitation and the prevention of accidents;
  (f)To develop preventive health care, guidance for parents and family planning education and services.
  3.States Parties shall take all effective and appropriate measures with a view to abolishing traditional practices prejudicial to the health of children.
  4.States Parties undertake to promote and encourage international co-operation with a view to achieving progressively the full realization of the right recognized in the present article.In this regard, particular account shall be taken of the needs of developing countries.

第25条(收容儿童的定期审查)


  签约国承认儿童为身体或精神的养护、保护或治疗为目的,被有权限之机构收容时,对其所受之待遇,以及收容有关之其他一切情况,有要求定期审查的权利。

Article 25


  States Parties recognize the right of a child who has been placed by the competent authorities for the purposes of care, protection or treatment of his or her physical or mental health, to a periodic review of the treatment provided to the child and all other circumstances relevant to his or her placement.

第26条(社会保障)


  一、签约国应承认所有儿童有接受包括社会保险之社会保障给付之权利。并应采取必要措施,使其权利能够依据国内法之规定完全达成。
  二、该项给付应依其情节,并考虑儿童以及负有扶养儿童责任者之财力状况,或儿童本人与代替儿童申请给付时有关之其他状况,作为决定给付之参考。

Article 26


  1.States Parties shall recognize for every child the right to benefit from social security, including social insurance, and shall take the necessary measures to achieve the full realization of this right in accordance with their national law.
  2.The benefits should, where appropriate, be granted, taking into account the resources and the circumstances of the child and persons having responsibility for the maintenance of the child, as well as any other consideration relevant to an application for benefits made by or on behalf of the child.

第27条(生活水准)


  一、签约国应承认所有儿童有为其身体、精神、道德以及社会之正常发展,获得相当水准之生活之权利。
  二、父母或其他对儿童负有责任者,应在其能力与财力许可范围内,保证儿童成长发展所必需之生活条件。
  三、签约国应依照国内之条件,在财力许可范围内,支援父母以及其他对儿童负有责任者,完成此项责任时所必需之适当措施。必要时,特别对营养、衣服以及住所,提供必要之物质援助与支援措施。
  四、签约国为使父母以及其他对儿童负有财务责任者偿还儿童之养育费,不管其居住在国内或国外,应采取一切适当之措施。对儿童负有财务责任者居住在与儿童不同国家时,签约国尤须要透过参加并缔结国际协定,或订定其他适当之协议,使其偿还养育费。

Article 27


  1.States Parties recognize the right of every child to a standard of living adequate for the child's physical, mental, spiritual, moral and social development.
  2.The parent(s)or others responsible for the child have the primary responsibility to secure, within their abilities and financial capacities, the conditions of living necessary for the child's development.
  3.States Parties, in accordance with national conditions and within their means, shall take appropriate measures to assist parents and others responsible for the child to implement this right and shall in case of need provide material assistance and support programmes, particularly with regard to nutrition, clothing and housing.
  4.States Parties shall take all appropriate measures to secure the recovery of maintenance for the child from the parents or other persons having financial responsibility for the child, both within the State Party and from abroad.In particular, where the person having financial responsibility for the child lives in a State different from that of the child, States Parties shall promote the accession to international agreements or the conclusion of such agreements, as well as the making of other appropriate arrangements.

第28条(教育)


  一、签约国承认儿童有接受教育之权利,为使此项权利能够在平等之机会下逐渐实现,特别要实现下列事项:
  1.实施初等教育义务化政策,使所有人均能免费接受初等教育。
  2.鼓励各种形态之中等教育,包括普通教育与职业教育,使所有儿童均能进入就读。并应试办免费教育,必要时得以采取财力上之协助等适当措施。
  3.要采取所有适当措施,使高等教育能够依照各人之能力,成为每个人均能利用之教育机构。
  4.使每个儿童均能利用教育与职业上之资讯和辅导。
  5.采取奖励措施,提高到校定期上课之出席率,并降低中途辍学比率。
  二、签约国应采取一切措施,保证学校校规之内容与儿童人权尊严不相违背,并保证遵照此条约之规定执行。
  三、签约国应关心教育问题,尤其应对消除全世界无知与文盲有所贡献。此外,为使科学技术、知识及最新教育方法得以普及使用,要奖励并促进国际间之含作。关于这个问题,特别应考虑开发中国家之需要。

Article 28


  1.States Parties recognize the right of the child to education, and with a view to achieving this right progressively and on the basis of equal opportunity, they shall, in particular:
  (a)Make primary education compulsory and available free to all;
  (b)Encourage the development of different forms of secondary education, including general and vocational education, make them available and accessible to every child, and take appropriate measures such as the introduction of free education and offering financial assistance in case of need;
  (c)Make higher education accessible to all on the basis of capacity by every appropriate means;
  (d)Make educational and vocational information and guidance available and accessible to all children;
  (e)Take measures to encourage regular attendance at schools and the reduction of drop-out rates.
  2.States Parties shall take all appropriate measures to ensure that school discipline is administered in a manner consistent with the child's human dignity and in conformity with the present Convention.
  3.States Parties shall promote and encourage international cooperation in matters relating to education, in particular with a view to contributing to the elimination of ignorance and illiteracy throughout the world and facilitating access to scientific and technical knowledge and modern teaching methods.In this regard, particular account shall be taken of the needs of developing countries.

第29条(教育目的)


  一、签约国同意下列儿童教育之目标:
  1.使儿童之人格、才能以及精神、身体之潜能获得最大极限之发展。
  2.发展尊重人权、基本自由以及联合国宪章所揭橥各种原则之理念。
  3.培养对儿童之父母、儿童本身文化之同一性,语言口与价值,以及儿童所居住之国家和其出生国之国民价值观,还有对与自己之文明迥异之其他文明,持有尊重之观念。
  4.培养儿童能够以理解、和平、宽容、两性平等,以及所有人民种族、国民以及宗教团体。或原住民之间友好共处之精神,使儿童得以在自由之社会中,过负责任之生活。
  5.发展儿童尊重自然环境之观念。
  二、本条与第二十八条之所有规定,必须完全遵守本条1所规定之原则:在各教育机构所施行之教育,也必须适合国家所规定之最低标准。上述规定不应被解释为妨碍个人以及团体设置管理教育机构自由之行为。

Article 29


  1.States Parties agree that the education of the child shall be directed to:
  (a)The development of the child's personality, talents and mental and physical abilities to their fullest potential;
  (b)The development of respect for human rights and fundamental freedoms, and for the principles enshrined in the Charter of the United Nations;
  (c)The development of respect for the child's parents, his or her own cultural identity, language and values, for the national values of the country in which the child is living, the country from which he or she may originate, and for civilizations different from his or her own;
  (d)The preparation of the child for responsible life in a free society, in the spirit of understanding, peace, tolerance, equality of sexes, and friendship among all peoples, ethnic, national and religious groups and persons of indigenous origin;
  (e)The development of respect for the natural environment.
  2.No part of the present article or article 28 shall be construed so as to interfere with the liberty of individuals and bodies to establish and direct educational institutions, subject always to the observance of the principle set forth in paragraph 1 of the present article and to the requirements that the education given in such institutions shall conform to such minimum standards as may be laid down by the State.

第30条(少数民族与原住民儿童)


  在种族、宗教或语言上有少数人民,或有原住民之国家中,这些属于少数民族或原住民之儿童,应该和构成此团体之其他成员一样,得以享有自己之文化,信仰并实践自己之宗教,使用自己之语言。此种权利绝不能被否定。

Article 30


  In those States in which ethnic, religious or linguistic minorities or persons of indigenous origin exist, a child belonging to such a minority or who is indigenous shall not be denied the right, in community with other members of his or her group, to enjoy his or her own culture, to profess and practise his or her own religion, or to use his or her own language.

第31条(休闲、娱乐及文化活动)


  一、签约国承认儿童拥有休闲及余暇之权利;有从事适合其年龄之游戏和娱乐活动之权利,以及自由参加文化生活与艺术之权利。
  二、签约国应尊重、促进儿童全力参与文化与艺术生活之权利,并应鼓励提供适当之文化、艺术、娱乐以及休闲活动之平等机会。

Article 31


  1.States Parties recognize the right of the child to rest and leisure, to engage in play and recreational activities appropriate to the age of the child and to participate freely in cultural life and the arts.
  2.States Parties shall respect and promote the right of the child to participate fully in cultural and artistic life and shall encourage the provision of appropriate and equal opportunities for cultural, artistic, recreational and leisure activity.

第32条(保护儿童免受经济剥削)


  一、签约国承认儿童有免受经济剥削之权利,和避免从事妨碍其接受教育机会,或对儿童健康与身体土、心理土、精神上、道德上与社会发展上有害之劳动之权利。
  二、签约国为确实保证本条文之实施,应采取立法、行政、社会和教育措施。 因此,签约国应参照其他国际文件中之有关条款,并特别从事下列工作:
  1.规定单一或两个以上之最低就业年龄。
  2.订定有关工作时间和工作条件之适当规则。
  3.为保证本条款之有效实施,要规定适当罚则和其他制裁方法。

Article 32


  1.States Parties recognize the right of the child to be protected from economic exploitation and from performing any work that is likely to be hazardous or to interfere with the child's education, or to be harmful to the child's health or physical, mental, spiritual, moral or social development.
  2.States Parties shall take legislative, administrative, social and educational measures to ensure the implementation of the present article.To this end, and having regard to the relevant provisions of other international instruments, States Parties shall in particular:
  (a)Provide for a minimum age or minimum ages for admission to employment;
  (b)Provide for appropriate regulation of the hours and conditions of employment;
  (c)Provide for appropriate penalties or other sanctions to ensure the effective enforcement of the present article.

第33条(保护儿童不受麻醉药品和精神扰乱剂之危害)


  签约国应采取一切包括立法、行政、社会以及教育之适当措施,保护儿童不受有关国际条约所订定之麻醉药品和精神扰乱剂之侵害,并防止利用儿童从事非法制造与买卖这些物质。

Article 33


  States Parties shall take all appropriate measures, including legislative, administrative, social and educational measures, to protect children from the illicit use of narcotic drugs and psychotropic substances as defined in the relevant international treaties, and to prevent the use of children in the illicit production and trafficking of such substances.

第34条(保护避免受到性剥削)


  签约国保证要保护儿童不受任何形态的性剥削和性迫害。因此签约国应采取包括国内、两国之间,或多国之间之适当措施,防止下列事情发生:
  一、引诱或强迫儿童从事非法之性行为。
  二、剥削并利用儿童从事卖淫或其他违法之性工作。
  三、剥削并利用儿童从事色情表演或作为色情之题材。

Article 34


  States Parties undertake to protect the child from all forms of sexual exploitation and sexual abuse.For these purposes, States Parties shall in particular take all appropriate national, bilateral and multilateral measures to prevent:
  (a)The inducement or coercion of a child to engage in any unlawful sexual activity;
  (b)The exploitative use of children in prostitution or other unlawful sexual practices;
  (c)The exploitative use of children in pornographic performances and materials.

第35条(防止诱拐买卖、交易)


  签约国应采取一切适当之国内、两国间或多国之间之措施,防止儿童受到任何方式或任何目的之诱拐、买卖或交易活动。

Article 35


  States Parties shall take all appropriate national, bilateral and multilateral measures to prevent the abduction of, the sale of or traffic in children for any purpose or in any form.

第36条(避免其他各种形式之剥削)


  签约国应保护儿童使其免受有害其福祉之各种形式之剥削。

Article 36


  States Parties shall protect the child against all other forms of exploitation prejudicial to any aspects of the child's welfare.

第37条(禁止刑求及剥夺自由)


  签约国应保证:
  一、所有儿童均不受刑讯或残忍、不人道,或有损儿童品格之处置或刑罚。也不得对十八岁以下之罪犯科以死刑,或不可能获得释放之无期徒刑。
  二、所有儿童均不受非法或用恣意之方法剥夺他们之自由。
  三、对丧失自由之儿童,除应以人道和尊重其人性尊严对待外,并应考虑其年龄之需要作适当之处理。对丧失自由之儿童,除非认为丧失自由之儿童与成年人相处较为有利,否则应与成年人隔离。又除非有例外之事情发生,儿童应该拥有与家人通信、见面与接触之权利。
  四、所有被剥夺自由之儿童,有迅速受到法律以及其他适当协助之权利,并有权就其自由被剥夺之合法性,在法院或其他具有权限之独立、公平机构提出抗辩,并要求作迅速之判决。

Article 37


  States Parties shall ensure that:
  (a)No child shall be subjected to torture or other cruel, inhuman or degrading treatment or punishment.Neither capital punishment nor life imprisonment without possibility of release shall be imposed for offences committed by persons below eighteen years of age;
  (b)No child shall be deprived of his or her liberty unlawfully or arbitrarily.The arrest, detention or imprisonment of a child shall be in conformity with the law and shall be used only as a measure of last resort and for the shortest appropriate period of time;
  (c)Every child deprived of liberty shall be treated with humanity and respect for the inherent dignity of the human person, and in a manner which takes into account the needs of persons of his or her age.In particular, every child deprived of liberty shall be separated from adults unless it is considered in the child's best interest not to do so and shall have the right to maintain contact with his or her family through correspondence and visits, save in exceptional circumstances;
  (d)Every child deprived of his or her liberty shall have the right to prompt access to legal and other appropriate assistance, as well as the right to challenge the legality of the deprivation of his or her liberty before a court or other competent, independent and impartial authority, and to a prompt decision on any such action.

第38条(从武力纷争中获得保障)


  一、签约国在发生武力纷争时,应该尊重适用于本国有关国际人道法之规定,并应保证确实会尊重这些规定。
  二、签约国应采取一切可行措施,保证十五岁以下之儿童不会直接参加战斗行为。
  三、签约国应禁止征召未满十五岁之儿童入伍。签约国在征召十五岁至未满十八岁儿童入伍时,应尽量让年纪较大者优先入伍。
  四、签约国应遵照国际人道法之规定,有义务保护非战斗人员,并采取一切可行之措施,保护和照顾受武力纷争影响之儿童。

Article 38


  1.States Parties undertake to respect and to ensure respect for rules of international humanitarian law applicable to them in armed conflicts which are relevant to the child.
  2.States Parties shall take all feasible measures to ensure that persons who have not attained the age of fifteen years do not take a direct part in hostilities.
  3.States Parties shall refrain from recruiting any person who has not attained the age of fifteen years into their armed forces.In recruiting among those persons who have attained the age of fifteen years but who have not attained the age of eighteen years, States Parties shall endeavour to give priority to those who are oldest.
  4.In accordance with their obligations under international humanitarian law to protect the civilian population in armed conflicts, States Parties shall take all feasible measures to ensure protection and care of children who are affected by an armed conflict.

第39条(身心健康之恢复以及社会重整)


  签约国应采取一切适当措施使遭受任何形式之疏忽、剥削或虐待之儿童:或遭受拷问以及其他各种虐待之不人道对待,或损伤其品格之处置以及遭受刑罚而牺牲之儿童:或遇到武力纷争而受到波及之儿童,能够恢复其身体和精神上之健康,并促进其社会重整。此种恢复与重整,需要在能够培育儿童之健康,自尊心与尊严之环境下才能达成。

Article 39


  States Parties shall take all appropriate measures to promote physical and psychological recovery and social reintegration of a child victim of: any form of neglect, exploitation, or abuse; torture or any other form of cruel, inhuman or degrading treatment or punishment; or armed conflicts.Such recovery and reintegration shall take place in an environment which fosters the health, self-respect and dignity of the child.

第40条(少年司法)


  一、签约国对触犯刑法而被起诉、问罪,或被认定为有罪的儿童,要承认他有权利要求合乎提升其尊严与价值之处置方式。此种方式应考虑能够加强儿童对他人之人权与基本自由之尊重,并适合儿童年龄之差别,与对儿童之社会重整和促进其担任建设社会之角色有所贡献为准。
  二、签约国为达成此目的,应注意有关国际文件之条款,并特别保证下列事项:
  1.任何儿童均不得因在他实际行为发生时,国内或国际法并无禁止其行为或不行为为理由,而被认为涉嫌违反刑法,其至被追诉或被认定有罪。
  2.被指控触犯刑事法而被问罪或被确定有罪之儿童,至少应保证下列各种事项:
  (1)依据法律证明有罪,否则应认定为无罪。
  (2)对其被怀疑之事实能够直接迅速被告知。或在适当情况下经由父母或法定监护人告知本人。在准备自我辩护以及提出抗辩之际,亦应受到法律或其他适当之协助。
  (3)在依据公正之法律审理,和法律或其他适当协助下,并经特别考虑儿童之年龄与其状况,认为会损及其最佳利益者外,要在儿童之父母或法定监护人出席之下,经有权限之独立、公平机构或司法机关,毫不延迟地作迅速裁决。
  (4)不得被迫作证或自白。可以对不利于自己之证人提出质问。并可以在平等之条件下,要求对自己有利之证人出席与询问。
  (5)被认为触犯刑法时,对其认定与结果之处置,必须依据法律,并经有权限之较高级独立、公平机关或司法机关再审理。
  (6)要让儿童了解审理机关所使用之语言。若为儿童不会使用之约语言时,应提供免费之翻译。
  (7)在诉讼之全部过程中,应充分尊重儿童之隐私。
  三、签约国应为触犯刑法而被起诉、问罪、或被认定为有罪之儿童,特别设置适用之法律,程序与机构设施。并应特别注意下列事项:
  1.要规定无触犯刑事能力之最低年龄。
  2.最适当、最好之方法是,要建立使儿童能在充分尊重人权与法律保障之下,不必经由司法程序而作适当处理之途径。
  四、为保证合乎儿童福祉,并以适合儿童之状况和犯罪之情况作适当之处理,应采取养护、辅导以及监督命令、观护、认养、教育以及职业训练计划,和代替设施内养护等各种措施。

Article 40


  1.States Parties recognize the right of every child alleged as, accused of, or recognized as having infringed the penal law to be treated in a manner consistent with the promotion of the child's sense of dignity and worth, which reinforces the child's respect for the human rights and fundamental freedoms of others and which takes into account the child's age and the desirability of promoting the child's reintegration and the child's assuming a constructive role in society.
  2.To this end, and having regard to the relevant provisions of international instruments, States Parties shall, in particular, ensure that:
  (a)No child shall be alleged as, be accused of, or recognized as having infringed the penal law by reason of acts or omissions that were not prohibited by national or international law at the time they were committed;
  (b)Every child alleged as or accused of having infringed the penal law has at least the following guarantees:
  (i)To be presumed innocent until proven guilty according to law;
  (ii)To be informed promptly and directly of the charges against him or her, and, if appropriate, through his or her parents or legal guardians, and to have legal or other appropriate assistance in the preparation and presentation of his or her defence;
  (iii)To have the matter determined without delay by a competent, independent and impartial authority or judicial body in a fair hearing according to law, in the presence of legal or other appropriate assistance and, unless it is considered not to be in the best interest of the child, in particular, taking into account his or her age or situation, his or her parents or legal guardians;
  (iv)Not to be compelled to give testimony or to confess guilt; to examine or have examined adverse witnesses and to obtain the participation and examination of witnesses on his or her behalf under conditions of equality;
  (v)If considered to have infringed the penal law, to have this decision and any measures imposed in consequence thereof reviewed by a higher competent, independent and impartial authority or judicial body according to law;
  (vi)To have the free assistance of an interpreter if the child cannot understand or speak the language used;
  (vii)To have his or her privacy fully respected at all stages of the proceedings.
  3.States Parties shall seek to promote the establishment of laws, procedures, authorities and institutions specifically applicable to children alleged as, accused of, or recognized as having infringed the penal law, and, in particular:
  (a)The establishment of a minimum age below which children shall be presumed not to have the capacity to infringe the penal law;
  (b)Whenever appropriate and desirable, measures for dealing with such children without resorting to judicial proceedings, providing that human rights and legal safeguards are fully respected.
  4.A variety of dispositions, such as care, guidance and supervision orders; counselling; probation; foster care; education and vocational training programmes and other alternatives to institutional care shall be available to ensure that children are dealt with in a manner appropriate to their well-being and proportionate both to their circumstances and the offence.

第41条(既有利益之确保)


  本公约之任何规定,不得影响下列规定中,对儿童权利之实现有更大贡献之条款规定:
  一、签约国之法令。
  二、在签约国具有效力之国际法。

Article 41


  Nothing in the present Convention shall affect any provisions which are more conducive to the realization of the rights of the child and which may be contained in:
  (a)The law of a State party; or
  (b)International law in force for that State.

第42条(公约的宣传)

Article 42


  States Parties undertake to make the principles and provisions of the Convention widely known, by appropriate and active means, to adults and children alike.

第43条(有关儿童权利委员会)


  一、为检讨签约国实现本公约所约定之义务之进展情形,设置有关儿童权利之委员会。委员会并执行规定之各项任务。
  二、委员会由十位德高望众,而且对本公约领域有高度素养之专家所构成。委员会委员由签约国从签约国国民中选出,并以个人身分担任职务。委员之选出应考虑地区之公平分配,以及主要之法律体系作适当之调整。
  三、委员会委员,由签约国就其提名名单中,以不记名投票之方式选出。每一签约国得自其国民中提名一位候选人。
  四、委员会之首次选举,应于本公约生效后六个月内举行,以后每两年举行一次。联合国秘书长应于选举日四个月前以书面通知各签约国,要求在两个月内把各国提名名单送齐。再由秘书长依英文字母顺序将所有名单编册(载明提名之签约国),遂给各签约国。
  五、委员选举由联合国秘书长召集,并在联合国本部举行之签约国会议上举行。会议需有三分之二以上签约国出席。并以获得出席投票最多数且超过半数之候选人为当选之委员。
  六、委员会委员之任期为四年。委员如再获提名,得再连任。不过首次选出之委员中,有五个委员之任期在二年就应终止。这五个委员在首次选举后,由会议主席以抽签方式决定。
  七、委员会委员死亡或辞职,或由于其他理由无法继续执行其任务时,提名该委员之签约国应从其国民中派其他专家,经委员会同意后,就未满期限继续任职。
  八、委员会应订定程序规则。
  九、委员会应选任职员,其任期为两年。
  十、委员会会议原则上在联合国总部或委员会决定认为适当之地方举行。委员会会议通常每年举行一次。委员会会期由本公约签约国会议决议后,经由联合国会员大会承认,必要时得作检讨改变。
  十一、为使委员会有效执行本公约所规定之各项任务,联合国秘书长应提供所需要之人员与设备。
  十二、本公约斯设之委员会委员,经由联合国会员大会之同意,并依据会员大会所决定之条件,从联合国之资金中获得酬劳。

Article 43


  1.For the purpose of examining the progress made by States Parties in achieving the realization of the obligations undertaken in the present Convention, there shall be established a Committee on the Rights of the Child, which shall carry out the functions hereinafter provided.
  2.The Committee shall consist of eighteen experts of high moral standing and recognized competence in the field covered by this Convention.1/ The members of the Committee shall be elected by States Parties from among their nationals and shall serve in their personal capacity, consideration being given to equitable geographical distribution, as well as to the principal legal systems.
  3.The members of the Committee shall be elected by secret ballot from a list of persons nominated by States Parties.Each State Party may nominate one person from among its own nationals.
  4.The initial election to the Committee shall be held no later than six months after the date of the entry into force of the present Convention and thereafter every second year.At least four months before the date of each election, the Secretary-General of the United Nations shall address a letter to States Parties inviting them to submit their nominations within two months.The Secretary-General shall subsequently prepare a list in alphabetical order of all persons thus nominated, indicating States Parties which have nominated them, and shall submit it to the States Parties to the present Convention.
  5.The elections shall be held at meetings of States Parties convened by the Secretary-General at United Nations Headquarters.At those meetings, for which two thirds of States Parties shall constitute a quorum, the persons elected to the Committee shall be those who obtain the largest number of votes and an absolute majority of the votes of the representatives of States Parties present and voting.
  6.The members of the Committee shall be elected for a term of four years.They shall be eligible for re-election if renominated.The term of five of the members elected at the first election shall expire at the end of two years; immediately after the first election, the names of these five members shall be chosen by lot by the Chairman of the meeting.
  7.If a member of the Committee dies or resigns or declares that for any other cause he or she can no longer perform the duties of the Committee, the State Party which nominated the member shall appoint another expert from among its nationals to serve for the remainder of the term, subject to the approval of the Committee.
  8.The Committee shall establish its own rules of procedure.
  9.The Committee shall elect its officers for a period of two years.
  10.The meetings of the Committee shall normally be held at United Nations Headquarters or at any other convenient place as determined by the Committee.The Committee shall normally meet annually.The duration of the meetings of the Committee shall be determined, and reviewed, if necessary, by a meeting of the States Parties to the present Convention, subject to the approval of the General Assembly.
  11.The Secretary-General of the United Nations shall provide the necessary staff and facilities for the effective performance of the functions of the Committee under the present Convention.
  12.With the approval of the General Assembly, the members of the Committee established under the present Convention shall receive emoluments from United Nations resources on such terms and conditions as the Assembly may decide.

第44条(签约国的报告义务)


  一、签约国保证在:
  1.该签约国公约效力生效之二年内。
  2.其后每五年,要对实现本公约认定之权利所采取之措施,以及享受这些权利所带来之一些进步情形,经由联合国秘书长向委员会提出报告。
  二、根据本公约所作之报告,如有对本公约之履行义务有某种程度影响之原因与障碍时,应载明这些原因和障碍。
  报告内容亦应把签约国执行本公约之情形予以记载,使委员会有充分之资讯作总括的了解。
  三、向委员会提出总括性最初报告之签约国,在提出一、2每五年报告时,无需重述以前所提出之基本资料。
  四、委员会得要求签约国就有关本公约之执行情形,提供进一步之资料。
  五、委员会应每二年经由经济社会理事会,同联合国会员大会提出有关活动报告。
  六、签约国应使本国之报告,能够被国内大众广泛利用。

Article 44


  1.States Parties undertake to submit to the Committee, through the Secretary-General of the United Nations, reports on the measures they have adopted which give effect to the rights recognized herein and on the progress made on the enjoyment of those rights
  (a)Within two years of the entry into force of the Convention for the State Party concerned;
  (b)Thereafter every five years.
  2.Reports made under the present article shall indicate factors and difficulties, if any, affecting the degree of fulfilment of the obligations under the present Convention.Reports shall also contain sufficient information to provide the Committee with a comprehensive understanding of the implementation of the Convention in the country concerned.
  3.A State Party which has submitted a comprehensive initial report to the Committee need not, in its subsequent reports submitted in accordance with paragraph 1(b)of the present article, repeat basic information previously provided.4.The Committee may request from States Parties further information relevant to the implementation of the Convention.
  5.The Committee shall submit to the General Assembly, through the Economic and Social Council, every two years, reports on its activities.
  6.States Parties shall make their reports widely available to the public in their own countries.

第45条(委员会的作业方法)


  为使本公约有效实施,并鼓励与本公约相同领域的国际合作,委员会采下列作业方式:
  一、在检讨实施儿童权利公约有关之规定时,联合国专门机构、联合国儿童基金会以及其他联合国组织有权选出代表就其权限范围内事项参与讨论。委员会认为适当且必要时,得以向上述专门机构、联合国儿童基金会以及其他有资格之团体征求其权限范围内关于执行本公约之专门性建议。委员会亦得以要求这些专门机构、联合国儿童基金会以及其他联合国组织,轨其活动范围内有关本公约之执行情形提出报告。
  二、委员会认为适当且必要时,得请求技术性建议与协助。并将需要协助之签约国报告,和针对这些要求与问题之委员会意见和提案送交专门机构、联合国儿童基金会与其他有资格团体。
  三、委员会得建议联合国会员大会,请联合国秘书长就委员会有关儿童权利之特定事项从事研究。
  四、委员会得以依据本公约第四十四条以及第四十五条所得之资料,提案或作一般性建议。这些提案或一般性建议,应送交各有关签约国。签约国如有建议事项,要连同其建议事项一并向联合国会员大会提出报告。

Article 45


  In order to foster the effective implementation of the Convention and to encourage international co-operation in the field covered by the Convention:
  (a)The specialized agencies, the United Nations Children's Fund, and other United Nations organs shall be entitled to be represented at the consideration of the implementation of such provisions of the present Convention as fall within the scope of their mandate.The Committee may invite the specialized agencies, the United Nations Children's Fund and other competent bodies as it may consider appropriate to provide expert advice on the implementation of the Convention in areas falling within the scope of their respective mandates.The Committee may invite the specialized agencies, the United Nations Children's Fund, and other United Nations organs to submit reports on the implementation of the Convention in areas falling within the scope of their activities;
  (b)The Committee shall transmit, as it may consider appropriate, to the specialized agencies, the United Nations Children's Fund and other competent bodies, any reports from States Parties that contain a request, or indicate a need, for technical advice or assistance, along with the Committee's observations and suggestions, if any, on these requests or indications;
  (c)The Committee may recommend to the General Assembly to request the Secretary-General to undertake on its behalf studies on specific issues relating to the rights of the child;
  (d)The Committee may make suggestions and general recommendations based on information received pursuant to articles 44 and 45 of the present Convention.Such suggestions and general recommendations shall be transmitted to any State Party concerned and reported to the General Assembly, together with comments, if any, from States Parties.

第49条(生效)


  一、本公约于联合国秘书长收存第二十个国家之批准文件或参加文件后第三十日生效。
  二、在第二十个批准文件或参加文件收存后获得批准或参加本公约之国家,须于批准文件或参加文件收存后第三十日始生效。

Article 49


  1.The present Convention shall enter into force on the thirtieth day following the date of deposit with the Secretary-General of the United Nations of the twentieth instrument of ratification or accession.
  2.For each State ratifying or acceding to the Convention after the deposit of the twentieth instrument of ratification or accession, the Convention shall enter into force on the thirtieth day after the deposit by such State of its instrument of ratification or accession.

第50条(修正)


  一、签约国均可提出修正案,或向联合国秘书长提出修正案。联合国秘书长应立即将修正案送交各签约国,针对各签约国是否对修正案之审议与投票举行签约国会议表示意见。 在修正案送达后四个月内,如有三分之一以上签约国同意开会时,秘书长应在联合国主办下召集会议。经由签约国超过半数之出席通过所采用之修正案,应提交联合国会员大会同意。
  二、依据本条文1被采用之修正案,应获得联合国承认,并获得三分之二以上多数签约国接受后始生效。
  三、修正案生效后,接受修正案之签约国要受其约束。其他签约国继续受修正前之公约之约束。

Article 50


  1.Any State Party may propose an amendment and file it with the Secretary-General of the United Nations.The Secretary-General shall thereupon communicate the proposed amendment to States Parties, with a request that they indicate whether they favour a conference of States Parties for the purpose of considering and voting upon the proposals.In the event that, within four months from the date of such communication, at least one third of the States Parties favour such a conference, the Secretary-General shall convene the conference under the auspices of the United Nations.Any amendment adopted by a majority of States Parties present and voting at the conference shall be submitted to the General Assembly for approval.
  2.An amendment adopted in accordance with paragraph 1 of the present article shall enter into force when it has been approved by the General Assembly of the United Nations and accepted by a two-thirds majority of States Parties.
  3.When an amendment enters into force, it shall be binding on those States Parties which have accepted it, other States Parties still being bound by the provisions of the present Convention and any earlier amendments which they have accepted.

第51条(保留)


  一、联合国秘书长应于签约国获批准或参加公约时接受保留条款之文件,并将它通知各签约国。
  二、与本公约主旨与目标相违背之保留条款不被承认。
  三、保留条款得随时通知联合国秘书长撤销,秘书长应将撤销之事通知各签约国。该撤销通知应于秘书长收到当日起生效。

Article 51


  1.The Secretary-General of the United Nations shall receive and circulate to all States the text of reservations made by States at the time of ratification or accession.
  2.A reservation incompatible with the object and purpose of the present Convention shall not be permitted.
  3.Reservations may be withdrawn at any time by notification to that effect addressed to the Secretary-General of the United Nations, who shall then inform all States.Such notification shall take effect on the date on which it is received by the Secretary-General

第52条(废弃)


  签约国得以书面通知联合国秘书长宣告退出公约。其退出于秘书长接获通知之一年后始生效。

Article 52


  A State Party may denounce the present Convention by written notification to the Secretary-General of the United Nations.Denunciation becomes effective one year after the date of receipt of the notification by the Secretary-General.

第53条(保管)


  联合国秘书长经指派为本公约之保管人。

Article 53


  The Secretary-General of the United Nations is designated as the depositary of the present Convention.

第54条(标准文)


  本公约以阿拉伯文、中文、英文、法文、俄文、西班牙文作成标准文本,保存于联合国秘书处。

Article 54


  The original of the present Convention, of which the Arabic, Chinese, English, French, Russian and Spanish texts are equally authentic, shall be deposited with the Secretary-General of the United Nations.In witness thereof the undersigned plenipotentiaries, being duly authorized thereto by their respective Governments, have signed the present Convention.
